General Terms and Conditions

  1. Applicability
    1. Our General Terms and Conditions shall be applicable to all members registered at machine-island.com.
    2. machine-island.com shall reserve the right to make changes to the General Terms and Conditions, special conditions, if any, and the description of services, and those changes shall also be applicable to existing contracts. The current version by be viewed at our homepage machine-island.com.
  1. Offers and Services by machine-island.com
    1. Services are specified in the respective agreed-upon service package.
    2. Machine-island.com shall guarantee a high degree of availability of the server, with the exception of time periods where the server is interrupted due to maintenance work or technical problems.
    3. The customer shall be entitled to present other companies or their products on our web server. However, no competitors of machine-island.com may be presented.
    4. Machine-island.com shall provide the customer with an access code which allows the customer to save, edit and cancel his own offer.
    5. The customer shall be obligated to treat the password with confidentiality. Machine-island.com shall not be liable for any violation thereof.
    6. The services of machine-island.com shall consist of feeding the machine-island.com exchange into the worldwide internet.
    7. From a technical and legal point of view, the services of machine-island.com shall be fulfilled in Salzburg (Austria). Any other venue from where machine-island.com may additionally be accessible shall be irrelevant for all contract, liability and law-related aspects of the place of fulfillment.  
    8. Machine-island.com shall not guarantee that the contents of the ads are compliant with the legal requirements of the respective country from which the offers and data may be accessible.
  1. Prices, Account Balance and Payment Terms
    1. The fee for the agreed-upon services shall be paid in accordance with the price list of machine-island.com.
    2. In case the customer exceeds the scope of the agreed-upon service package, he shall be obligated to pay the price of the actual service package used without requiring a separate agreement on same.
    3. In case of payment default, machine-island.com shall charge default interest in the amount of 10% above the base interest rate, unless machine-island.com can document higher damage amounts.
    4. Any costs incurred through foreign booking transactions shall be borne by the respective dealer.
    5. Each user shall require a separate registration.
    6. Any price changes must be announced by machine-island.com on a timely basis such that any participating members may cancel their contract prior to the price increase taking effect while still in compliance with the contractual cancellation notice period. Inasmuch as any member does not exercise such right and continues to use the services of machine-island.com after the effective date of said price changes, the price change itself shall be deemed accepted and binding for both parties to the contract. 
  1. Advertisements
    1. The objective of ads shall be the sale of products and/or accessories.
    2. Each product shall only be advertised once at any given time and by one advertiser only.
    3. The ads may include photos. The photos must be of the actual product being offered. It shall not be permitted to use different images, letters, numbers, logos, lettering, telephone numbers, names, key words, or any combination of the photos with other images, letters or numbers in such ads, or to modify the photos accordingly.
    4. The advertiser must have possession of the actual product offered, and such ownership must not be subject to any encumbrances.
    5. The advertiser may specify only one location for the product advertised by him. In case the location of the advertised product changes, the advertiser shall be obligated to correct the respective ad immediately by specifying the new location.
    6. Formulation, contents, visual impression and intended purpose of the ad must not violate any existing laws, specifically any existing laws and ordinances of the Federal Republic of Austria. Through the placement of ads and posting of images on the internet market of machine-island.com, the advertiser implicitly states that he is authorized to use said photos and that they are not in violation of any rights of third parties. In general, machine-island.com shall reserve the right to reject, modify or delete certain ads, and to exclude individual advertisers from participating in the service. No grounds shall be necessary for such exclusions.
  1. Warranty
    1. Machine-island.com shall only provide the technical requirements for transferring information, and shall not be involved, neither as broker, party or representative of a party, in the contractual relationship between seller and potential buyer.
    2. Advertisers shall be liable for their ads. The advertiser shall be solely responsible for the accuracy and contents of the ads. Machine-island.com shall not be liable for the accuracy and/or completeness of the ads.
    3. Machine-island.com shall not guarantee that the ads are deleted at a certain time.
  1. Liability of machine-island.com
    1. Machine-island.com shall not be liable for any damages caused by software which originates from machine-island.com. By installing the software on the member’s computer, the respective member expressly acknowledges such exclusion of liability.
    2. Machine-island.com shall not be liable for any damages caused to members or third parties as a result of technical problems or other events outside the realm of responsibility of machine-island.com.
    3. Any offers presented by machine-island.com are the sole responsibility of the respective advertisers or participants.
  1. Data Privacy
    1. The participant/user hereby grants permission for the relevant data, subject to the data privacy laws of the Federal Republic of Austria, to be stored electronically.
  1. Usage Rights
    1. All data shall be subject to copyright protection, machine-island.com is the owner of all usage rights, all website contents, and the database.
    2. Various changes, reprocessing and use of the website or database in media of all types by third parties shall require the written permission of machine-island.com. The rights of advertisers shall remain in effect.
  1. Information and Offers
    1. Machine-island.com shall be entitled but not obligated to provide customers and inquiring parties with additional information from inside or outside sources, plus additional offers in the context of the intended or implemented purchase.
  1.  Severability Clause
    1. In case any provision in these General Terms and Conditions proves to be ineffective, null and void or invalid, the remainder of these regulations shall not be affected.
